SOLE SOURCE PROCUREMENT- The proposed contract action is for the supplies or services for which the Government intends to solicit and negotiate with one source only Teledyne Lecroy Inc. of Chestnut Ridge, New York, Cage Code 55716, under the authority of FAR 12.201-1 FOR Commercial items using Simplified Acquisition procedures. This is being solicited on a sole source only basis because Teledyne LeCroy, is the Original Equipment Manufacturer for this Oscilloscope and the only viable procurement path to guarantee the proprietary, tier-one technical support and non-severable software updates required to maintain uninterrupted system certification and mitigate long-term operational risk. Introducing an alternate manufacturer's asset would force the Government to incur a substantial, non-recoverable duplication of cost totaling $180,000, which includes $57,600 for proprietary software driver development, $64,800 for engineering modifications and test set correlation, and $57,600 for technician-led validation testing. These costs would not be recouped by a competitive action. All responsible sources may submit a capability statement, which shall be considered by the agency. However, a determination by the Government not to compete with this proposed contract based upon responses to this solicitation is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
