The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b)(1)(i) and FAR 6.302-1: Only one responsible source has been identified as reasonably available to provide the supplies and/or services that will satisfy the Agency requirements. Additionally, RFO FAR 6.103-1 (Only one responsible source and no other supplies or services will satisfy agency requirements) is the statutory authority that allows the Government to restrict competition to only one responsible source (or a limited number of sources for DoD, NASA, and the Coast Guard). PH Tool, LLC specializes in fabricating and/or modifying provided test props and providing micro-hole drilling services. This is the only known company that has the proven capability of producing repeatable defects in the nuclear c-canopy welded joint design that we need that are made IAW NSTR-99 Qualification Examination Requirements for Nondestructive Test Personnel. The C-Canopies require defects IAW NSTR-99, to ensure that an inspector can verify if these are acceptable or not. Unfortunately, NNSY does not have the capability to make the defects in house. PH Tool will accept our provided blank c-canopy seal weld test props and only provide drilling services by passing the test prop fabrication expense. PH Tool can deliver these test props by the required date of June/July 2026.This is in line with our targeted training and certification schedule. If these test props are not received by June/July 2026, inspector's certifications will lapse. This will result in the delay ofi nspectors' re-certifications and their ability to perform nuclear inspections on naval assets in a timely fashion. Norfolk Naval Shipyard's (NNSY) intends to solicit, negotiate, and award a sole source Firm Fixed Price (FFP) Contract to PH TOOLS, LLC (CAGE Code: 0NA33) to perform the work described in the attached Statement of Work. NNSY will provide 5 blank c-canopy seal weld test props to the contractor. Contractor must manufacture test-prop c-canopies in accordance with NSTR-99 Qualification Examination Requirements for Nondestructive Test Personnel. The Contractor will micro-drill holes into each test prop in the corresponding locations shown on the drawings provided by NNSY for each c-canopy and they shall be drilled in the exact locations as shown on the drawings (IAW SOW). Test props shall include flaws (e.g., micro-drilled holes) that are designed to test a candidate's ability to properly remove excess penetrant from the test prop. These types of flaws shall be considered for potential use as critical parameters. The Contractor shall create an AutoCAD or similar answer key and blank answer key that corresponds to the individual test props.
