ANSWER: The licensing and certification requirements in PWS paragraph 1.4.6 may be satisfied by qualified personnel of a subcontractor, provided those individuals possess and maintain the required licenses and certifications from the Commonwealth of Puerto Rico and the EPA. The prime contractor remains fully responsible for ensuring that all subcontractor personnel comply with the entire PWS, including qualification requirements, access procedures, and any required flow-down terms and conditions. The Government has no privity of contract with any subcontractor and will not direct or coordinate subcontractor personnel. Prospective prime contractors are responsible for determining the responsibility of their subcontractors in accordance with FAR 9.104-4 and must comply with all applicable requirements of FAR Subpart 9.1, including restrictions on subcontracting with debarred or suspended entities.
