This requirement is for pavement repair and marking services. This requirement will be acquired via a Basic Ordering Agreement (BOA) and is subject to the Davis Bacon Act Wage Determination. Per RFO 16.703-1(a), a BOA is a written instrument of understanding, negotiated between an agency, contracting activity, or contracting office and a contractor, that contains (1) Terms and clauses applying to future contracts (orders) between the parties during their term, (2) A description, as specific as practicable, of supplies or services to be provided, and (3) Methods for pricing, issuing, and delivering future orders under the basic ordering agreement. A basic ordering agreement is not a contract. BASIC ORDERING AGREEMENT(S) ISSUED THROUGH THIS COMBINED SYNOPSIS/SOLICITATION ARE NOT CONTRACTS BUT AGREEMENTS BETWEEN 934th AIRLIFT WING, MINNEAPOLIS AND THE RESPECTIVE CONTRACTOR(S). A CONTRACT OR ORDER WILL BECOME BINDING UPON ISSUANCE OF A CONTRACT OR ORDER, AGAINST THE CONTRACTOR'S RESPECTIVE BOA, BY THE CONTRACTING OFFICER. (RFO 16.703-3(b)(4)). Orders issued under this BOA shall require Davis-Bacon wage rates depending on specific activities within the order. The appropriate wage determination will be included in every BOA and proceeding order. The Offeror must be an authorized, qualified, and certified vendor and must provide pricing on an all or none basis. Written proposals are required (oral offers will not be accepted). It is the Government's intent to establish BOAs with capable Small Businesses, Small Disadvantaged Businesses, Service Disabled-Veteran Owned Small Businesses, Women-owned Small Businesses, HUBZone Small Businesses, and 8(a) companies.
