The provisions and clauses incorporated in this solicitation are those in effect through the Federal Acquisition Regulation and Defense Federal Acquisition Regulation Supplement as of the date of issuance and are included in the attached SF 1449. For commercial acquisitions using simplified procedures under FAR Part 12, Buy American applies unless the value exceeds the applicable Trade Agreements threshold, in which case Trade Agreements apply – except where an exception applies. The Naval Surface Warfare Center Dahlgren Division (NSWCDD) intends to procure products/service manufactured by Herrick Technology Laboratories. See the attached Requirements List, as applicable. Herrick Technology Laboratories is located in Manchester, New Hampshire. Technical data packages, specifications, statements of work, etc. suitable for full and open competition have not been developed as this company currently holds all copyrights and patents on its hardware and software, individually and as an integrated system. Thus, the systems can only be manufactured by and sourced from HTL. The network framework and operator interfaces are already explicitly built around this exact HTL unit as well. The unit must be compatible (form, fit, and function) with the current system and platform architecture. Proprietary data limits competition with no authorized resellers available for this proprietary unit. All costs associated with this requirement must be included in the quoted price.
